Conditions of sale


Each lot has an estimated market value based on the gallery selling price. The estimated value is intended as a guide to assist you in your bidding. All lots are offered subject to a confidential reserve bid. 


All bids are per lot as numbered unless otherwise announced by the auctioneer at the time of sale. All bidders must be registered to bid and provide a valid credit card number at the time of registration. If your bid is successful, your credit card will be charged unless alternative arrangements are made prior to leaving the auction. Title to the purchased lot will then pass to you whereupon you will assume full risk and responsibility for the work(s) purchased by you. Transportation from the auction site may be arranged. In the event that the highest bid is less than the reserve bid, the auctioneer reserves the right to remove the lot from sale at his discretion. In the event of a dispute between bidders, a missed bid, or doubt as to the validity of a bid, the auctioneer will be the sole and final authority and will either determine the successful bidder or cancel existing bids and reopen the bidding at his discretion. Should such a dispute occur after the auction, the record of the auction proceedings shall be conclusive.


All sales are final. Purchases may not be returned, refunded, or exchanged. All property is sold as exhibited. Successful bidders should be prepared to pay for their purchase(s) by cash, MasterCard or Visa on the evening of the auction. Esse reserves the right to withdraw any work of art at any time prior to the auction. Artworks sold during the auction will be exempt from taxes.


All works must be paid for at the close of the auction. Purchasers must pick up works at the conclusion of the evening and provide proof of payment. Profes­sional delivery can be arranged onsite at the purchaser’s expense. Packing and handling of purchased lots are entirely at the risk of the purchaser, and esse is not responsible for acts or omissions of carriers or packers of purchased lots whether recommended by esse or not.


Successful bidders will be notified by telephone on Friday, November 22, 2019 and purchase(s) will be charged to your Visa or MasterCard as indicated on your completed form. Esse can arrange delivery of the work(s) at the purchaser’s expense. Artworks sold during the auction will be exempt from taxes.


Esse makes no warranties or representation of any kind or nature with respect to any work of art, including but not limited to any representation or warranty, description, genuineness, attribution, provenance, or physical condition, nor as to the right of reproduction, if any. Bidders and purchasers may not rely upon any statement of esse, oral or otherwise, other than as set forth in these conditions of sale.
