The following terms and conditions govern and apply to your use of the Vendu - Sold website (the "site").
When you access or browse the site, you declare that you have read and understood the terms and conditions of use and declare that you are bound by these conditions. Please note that we may change the terms of use at any time and without notice. Your continued use of the site will be considered your acceptance of the revised terms and conditions.
1. Intellectual property
Any intellectual property on the site, with the exception of the Drupal software code and user-generated content as defined below, is owned by us or our licensees and includes any copyrighted, trademark or patent items. All registered trademarks are owned, registered and/or licensed by us. All content on the site, with the exception of user-generated content as defined below, including, but not limited to, text, design, graphics, photos, sounds, music, videos, applications, interactive features and other content, is a collective work under Canadian law or under any other copyright law and is the property of Les éditions Esse.

2. Using company content
We may provide you with certain information due to your use of the site, including, but not limited to, documents, data or information developed by us, or any other element that could assist you in the use of the site or services (the "Organization's Content"). The Organization's Content cannot be used for anything other than the use of the site and the services offered on the site. Nothing hereth can be intepreted as granting you a license or intellectual property rights.
3. Drupal software code
The site was designed using the Drupal content management platform. Drupal code is distributed freely under GNU General Public License.
4. Usern-generated content
"User-generated content" includes communications, items, information, data, opinions, photos, profiles, messages, notes, hyperlinks, textual information, designs, graphics, sounds or any other content that you and/or other users of the site publish or make available on or across the site, except for content that is our property.
5. Acceptable use of the site
You agree not to use the site for unlawful purposes or any other purpose prohibited under this clause. You agree not to use the site in any way that could adversely affect Les éditions Esse website, services or business.
You also agree not to use the site for the following purposes:
a) harassing, abusing or threatening others or otherwise violating a person's rights;
b) violating the intellectual property of Les éditions Esse or any other third party;
c) download or transmit computer viruses or other software that could damage the property of Les éditions Esse or others;
d) commit fraud;
e) create or participate in gambling, lottery or an illegal pyramid scheme;
f) publish or distribute obscene or defamatory material;
g) publish or distribute any material that incites violence, hatred, or discrimination against any group; and/or
h) illicitly collecting information about others.
6. Privacy
By using our site, you may provide us with some information. By using the site, you allow us to use your information in Canada and in any country in which we may operate.
When you sign up for a user account, you provide us with a valid email address and you may also be able to provide us with additional information, such as your name and/or billing information. Depending on how you use our site, we may also receive information from external applications that you use to access our site or we may receive information about you through various web technologies such as cookies, historical data, invisible pixels (also called "invisible GIFs"), tags and others.

We are not responsible for the security of your user account or the content of your account. Using the site is at your own risk.
9. Compensation
You agree to defend, compensate and keep Les éditions Esse and its affiliates unscathed against any claim, lawsuit or demand, including legal fees, that may arise from or relates to your use or abuse of the site, your violation of this or your conduct and actions. If we choose to do so, we will choose our lawyer and participate in our own defence.
10. Spam policy
You are strictly prohibited from using the site or any service offered on the site for the purpose of illegal activities related to spam, including collecting addresses and personal information of others or sending mass commercial emails.
11. Links and third-party content
We may post links to third-party sites or services. We are not responsible for any damage or loss related to the use of third-party services whose link is found on our website.
12. Independence of clauses
If one of these clauses is recognized as unlawful, declared null or void, in whole or in part, the unenforceable portion will not affect the validity and applicability of the other terms of use.
13. Service interruptions
We may have to interrupt your access to the site in order to carry out maiointenance work or unplanned emergency work. You agree that your access to the site may be affected by unplanned or unwanted downtime for any reason, and that we will not be held responsible for any damage or loss resulting from this unavailability.

16. Limitation of liability
We are in no way responsible for any damage you may suffer as a result of your use of the site, to the fullest extent of the law. The maximum liability of Les éditions Esse arising from your use of the site is limited to one hundred (100) Canadian dollars. This applies to any claim that includes, but is not limited to, loss of profits or income, indirect or punitive damages, negligence, civil liability or fraud of any kind.
